OMW Secures Defense Verdict for a Pulmonologist in a Medical Malpractice Jury Trial

Jeremy W. Willett successfully defended a Pulmonologist in a jury trial in Porter County Superior Court, Valparaiso, Indiana. The Plaintiff alleged that the Defendant Pulmonologist negligently prescribed Levaquin to a patient taking high doses of Prednisone after being involved in a house fire and sustaining smoke inhalation. During trial, the defense brought the Pulmonology member of the Medical Review Panel (who had changed his original unfavorable panel opinion), and an independent expert in the field of Pulmonology. Both testified that the decision to prescribe Levaquin was appropriate and within the standard of care in 2010. The jury heard six days of evidence between May 16, 2017 and May 25, 2017 and then returned a verdict in favor of the Defendant Pulmonologist.
