OMW Obtains Summary Judgment for Psychiatrist in Medical Negligence Case

Plaintiff alleged that a failure to appropriately treat withdrawal symptoms caused the death of the patient. Plaintiff supported her position with testimony from a psychiatrist, who testified there were multiple failures by the Defendant psychiatrist. Through cross examination, the Plaintiff’s expert psychiatrist was challenged regarding his opinions and, ultimately, conceded many issues central to his malpractice opinion. The Defendant moved for summary judgment based upon the admissions from the Plaintiff’s expert. The Marshall County Circuit Court granted summary judgment for a psychiatrist accused of medical malpractice.
