OMW Secures Defense Verdict for General Surgeon

O’Neill McFadden & Willett LLP Partners, Mike O’Neill and Marian Drenth, successfully defended a General Surgeon in a wrongful death jury trial in Monroe Circuit Court, Bloomington, Indiana.  The Plaintiff alleged that the surgeon was negligent in failing to restart the patient’s anti-coagulation medication at the time of her initial discharge following a subtotal colectomy and then failed to do an exploratory surgery when the patient returned to the hospital two days after discharge.  Prior to trial, this case was reviewed by the Indiana Court of Appeals and accepted on transfer by the Supreme Court to address the issue of whether Plaintiff could pursue the “anti-coagulation” issue from the initial hospital stay since that issue was not presented to the Medical Review Panel.  See McKeen v. Turner, 61 N.E.3d 1251 (2016) (Ind. Ct.
