OMW Secures Summary Judgment in Premises Liability Case

Julie R. Murzyn and Daniel F. Ford prevailed at the trial court level in St. Joseph County, Indiana on a claim involving allegations of personal injuries resulting from a fall at a local university during campus office renovations. OMW argued, in relevant part, that no evidence existed to demonstrate that its client was in control of, or otherwise handled the instrumentality which allegedly caused Plaintiff’s fall and resultant injuries. Following oral argument on the motion, the St. Joseph County Superior Court entered summary judgment on behalf of OMW’s client. The entry of summary judgment was not appealed. Angela Wesley v.
